1.1 Your use of this Website is subject to these Terms and Conditions (“Terms”), our Privacy Policy and any other laws or regulations which apply to this website.

1.2 Allneeds Computers Pty Ltd ABN 57511389752 ACN 110 888 054 trading as ‘Allneeds Computers’ (“Allneeds”) permits Users including but not limited to clients, customers or purchasers (“User or Users”) to access and use the Allneeds Website including using the services and functionality made available through the Website, viewing Content (as defined in clause 4.2) provided by Allneeds, communicating with Allneeds, reviewing product information and placing an order for products, services or both through the online store and/or physical store.

1.3 By placing an order for goods, equipment, computer or other parts, software and/or products (“products”) or for the provision of services from the Website, Users fully agree to these Terms.

Secure data

2 Allneeds does not guarantee nor warrant that any information or data transmission is totally secure. Users therefore transmit information and data to the Website at their own risk. However, Allneeds does take precautions to protect information and take reasonable steps to preserve your transmissions and data security. Viruses

3.1 Allneeds cannot guarantee that this Website is free from viruses, fault or other conditions which could damage or interfere with your computer systems or equipment and we do not guarantee nor warrant that your access to the Website will be uninterrupted, error free or that any defects will be corrected.

3.2 Users assume the risk of any damage to their property as a result of using this Website and to the maximum extent permitted by law, Allneeds disclaim all liability for any errors, omissions and faults.

3.3 Users must take their own precautions to ensure that the process which they use for accessing the Website does not expose them to the risk of viruses, malicious computer code or other forms of interference which may damage their own computer system or equipment. Allneeds does not accept responsibility for any interference or damage to Users own computer system or equipment which arises in connection with their use of the Website or any other website linked to the Website.

Content

4.1 The Website is owned and operated by or on behalf of Allneeds.

4.2 All intellectual property rights (including copyright and patents) in the information, comment, content, communication, advice, text, training materials, trademarks, logos, service names and trade names of Allneeds, images of people or places or other content (“Content”) contained in the Website are owned or licensed by Allneeds.

4.3 Allneeds may from time-to-time review and update these Terms to take into account new laws, regulations, products, technology or trading conditions. A Users usage of the Website will be governed by the most recent Terms posted on the Website. By continuing to use the Website, Users agree to be bound by the most recent Terms. It is the Users responsibility to check the Website regularly for updated versions of the Terms.

4.4 The Content on the Website is for general information purposes only. Allneeds does not warrant or make any representations as to any third-party products or services described or referred to on the Website. Any use of or reliance upon the Content by another person or organisation is at the User's own risk.

4.5 The Website, its contents and any information provided to Users may contain typographical errors, technical inaccuracies, price inaccuracies or other errors and may not be accurate, complete or current. Allneeds shall not be liable for any such errors. Please report to Allneeds any errors or omissions in any information through our customer feedback email address [email protected].

4.6 All pictures and colour of the products as shown on the Website are for illustrative purposes only and Allneeds does not guarantee nor warrant the accuracy of pictures and colour depicted on the Website nor that the products are still available or in stock for purchase.

4.7 The Content on the Website is obtained and developed from a variety of sources including but not limited to collaborations with third parties and information provided by third parties under licence. Inclusion of Content on the Website is not an endorsement by Allneeds of any organisation, product or service.

4.8 Allneeds may modify any information on the Website (including Content) at its own discretion for any reason. All updates and modifications to the Website (including Content) will be subject to these Terms.

4.9 If Users have a complaint regarding any Content on the Website, Allneeds sole obligation will be to review any written complaint notified to it and, if it sees fit, in its absolute and sole discretion, to modify or remove the particular Content.

Use of Your Information and Material

5. Allneeds appreciates any suggestions or information that Users may have regarding ways in which the Website may be improved or materials which we may add to the Website. Any such suggestions or information that Users submit to Allneeds shall not be regarded as confidential and shall become the property of Allneeds. Allneeds may use, reproduce, disclose, publish, modify, adapt and transmit such suggestions or information to others, without restriction or any obligation upon Allneeds to compensate Users.

Prohibited and Improper Use

6.1 Users must not use the Website for any inappropriate or unlawful activities such as transmitting, uploading, authorising, retrieving or storing offensive materials (including photographs, videos, audio files or text), which are harassing, defamatory, discriminatory, in breach of any copyright, pornographic, illegal or breach anyone’s privacy or in breach of any applicable laws or regulations or otherwise for any unlawful purpose.

6.2 Allneeds may immediately remove any such material in its absolute discretion without further notification to the User.

Orders Online and Instore

7.1 By using the Website and/or registering an Account, Users warrant to Allneeds that they are at least 18 years of age and possess the legal authority to enter into, and use the Website in accordance with these Terms. Users agree to be financially responsible for all of their use of the Website (as well as for use of their Account by others, including without limitation minors (under 18 years old).

7.2 By placing an order via the online store or physical store Users are making an offer and commitment to purchase products, services or both in accordance with these Terms. An order is subject to acceptance or rejection by Allneeds in its discretion after receipt of the order.

7.3 Allneeds may request to have the Users email, a copy of their credit card and drivers’ licence when placing an order with credit card details that are not verifiable.

7.4 Allneeds has a verification process for online orders placed with credit cards to ensure protection to the credit card holder and Allneeds. This process will include a random small amount charged to your credit card. Users are required to verify this amount with their financial institution and contact Allneeds with the correct amount. Once the correct amount is verified, Allneeds will proceed with the order and the verification amount will be fully refunded to the User.

Pricing for products and/or services Online and Instore

8.1 The Website may contain price inaccuracies and Allneeds does not guarantee nor warrant that pricing is accurate, complete or current.

8.2 Unless expressly stated herein, prices do not include installation, configuration or delivery charges, which are available on a fee for service basis.

8.3 Allneeds reserves the right to change the prices of products or services at any time without notice.

8.4 All pricing is GST inclusive unless expressly stated otherwise. The cart in the Website will display the GST component separately.

8.5 Products or services offered on the Website are priced based on a cash price paid instore subsequently, or by direct deposit and EFTPOS. Credit card and other forms of payment may attract a service fee.

8.6 Allneeds does not accept payment of credit card over the phone or sent via email or text message. The Website provides facilities for payment by credit card.

8.7 Allneeds shall be entitled to charge collection fees and interest upon all outstanding amounts at the rate of 15% per annum calculated daily. In the event that Allneeds needs to engage solicitors to recover outstanding amounts, Users shall be liable to reimburse Allneeds for all such solicitors fees and disbursements including but not limited to court filing fees on a full indemnity basis.

Ownership and Title of Products

9. Ownership and title to products only passes to the User once Allneeds has received clear payment for the products in full.

Cancellation, Refunds, Repairs and Exchanges

10.1 Provided Users have not accepted delivery of products, where possible, Allneeds may in its absolute discretion permit an order to be cancelled, but cancellations cannot be guaranteed once any applicable payment is received for the order. The order cannot be cancelled by the User once they accept delivery of the products.

10.2 Allneeds may at any time for any reason as it sees fit and in its absolute discretion whether or not the Users credit card or any other means of payment has occurred, issue a refund for an order when the order has been cancelled by Allneeds. Allneeds does not accept any liability for any delay in cancellation or refund as a result of Allneeds discretionary actions.

10.3 If Users are eligible for a refund or cancellation any shipping and or insurance charges are non- refundable.

10.4 A 20% restocking fee applies for returns and exchanges of non-faulty products.

10.5 In order to obtain a refund, exchange or to repair a product purchased from Allneeds Users must provide proof of purchase such as a receipt or invoice.

10.6 It is the Users’ sole responsibility to make and retain regular backups of data and software before presenting equipment to Allneeds for further work or repairs. Allneeds shall not be responsible for the consequences of lost or corrupted data or software, regardless of the cause.

Warranty

11.1 Allneeds warrants that its work will be performed with due care and skill and that all materials supplied will be reasonably fit for the purpose for which they are supplied, but otherwise accepts no liability for work performed or for materials supplied by others. This warranty is in lieu of all other warranties, expressed or implied.

11.2 External improper installation of products not performed by Allneeds is not covered under warranty. Users must seek professional assistance if required, to avoid paying any unnecessary cost for replacement or repair of such products.

11.3 All warranties and guarantees by Allneeds are expressly excluded in circumstances where equipment shows signs of abuse and/or deliberate damage or unauthorised attempts to repair.

11.4 Users shall be liable for Allneeds fees and charges and out-of-pocket expenses for repairs performed outside of the time limits of any warranty or not otherwise covered by any warranty.

11.5 Allneeds expressly disclaims all liability regarding the operation or suitability of software. Software warranties (if applicable) are provided only by the original publishers or suppliers of that software.

11.6 The User is bound by the pixel policy warranty of the manufacturer for display units, computer screens and computer monitors and Allneeds is not liable for any defective pixels and disclaims all liability.

General Terms and Conditions

12.1 Any recommendations or compatibility checks provided by Allneeds are an opinion only. Allneeds always recommend that Users undertake their own research and contact manufacturers directly to confirm any required details, specifications or compatibility of products before purchase. Allneeds accept no responsibility or liability for items not being suitable or compatible to the Users existing equipment or requirements.

12.2 To the maximum extent permitted by law, Users agree that the maximum aggregate liability of Allneeds for all proven losses, damages and claims arising out of or in connection with these Terms or a supply under these Terms, including liability for breach, in negligence or in tort or for any other common law or statutory action, is limited to the sum of ONE HUNDRED dollars ($100.00) AUD.

12.3 Any extension of time or other indulgence granted by Allneeds shall not constitute a waiver nor in any way affect its full rights and entitlements hereunder.

Shipping Policy

13.1 Allneeds offer the choice of shipping or delivery using Shippit a cloud-based logistics company which utilises Third Party Couriers. Shipping and delivery of orders will be in accordance with the delivery terms of the Third Party Couriers. Allneeds also ship using Australia Post.

13.2 Shipping costs are influenced by the size and weight of the products comprising the Users order and location. Users can see the pricing on the available shipping options by entering their post code into the freight calculator. This calculator appears on the lower half of the screen of the website when Users add items to their shopping cart. Some items in Allneeds range are too large for Australia Post to process and deliver.

13.3 Allneeds aim to ship all orders, where products are in stock, within 1 to 4 business days. If for any reason Allneeds is unable to dispatch an order we will notify the User within 2 business days. Shipping times are estimated at between 1 to 12 business days depending on your location within Australia, but are subject to the delivery terms of the Third Party Couriers. A Users order may be shipped in multiple parcels/consignments.

13.4 Once an order has been dispatched Allneeds will use reasonable endeavours to send an email to the User with relevant tracking information. If a User has not received their tracking number, kindly contact Allneeds on [email protected].

13.5 Users may be required by the Third Party Couriers to provide proof of identification for verification checks. Should the address provided be incorrect and the freight returned to us, the User will be responsible for any additional freight cost or return to sender fees.

13.6 The User is responsible for all extra freight charges including redelivery, redirection, refused shipments and incorrectly given delivery details.

13.7 Allneeds Computers shall not be held responsible for lost or damaged items if Users use their own or third party couriers.

13.8 Risk of products purchased from Allneeds shall pass to the User immediately upon delivery of the products to the User, or the User’s agent or carrier or upon payment in full of the products, whichever occurs first.

13.9 Claims by Users for damage in transit, incorrect item or incorrect delivery must be reported in writing within 3 business days of delivery and the products returned to Allneeds within 14 days of approval. Please contact Allneeds on [email protected] to initiate a claim. Allneeds shall not be liable for any coverage or liability for issues reported after these time frames. If items received are not as per the Users order or are an incorrect item, please do not open any original packaging or use the items, as this will be deemed an acceptance of the delivery and Allneeds shall not be liable to accept the item for return or exchange or refund.

Pickup In Store

14. All instore pick-up orders can only be collected once Allneeds have processed Users orders and have sent Users a verification email or phone call stating that your order is ready for pick up.
